Fealthy Terms of Service

1. Who We Are & What These Terms Cover

1.1. These Terms of Service (the “Terms”) govern access to and use of the Fealthy personal finance management application for Android/iOS and the web version (together, the “Services”) owned and operated by FEALTHY LLC (the “Company,” “we,” “us”).

1.3. Our Services are available at:

1.4. By using the Services, you agree to these Terms and to our Privacy Policy.

2. Definitions

2.1. User / you — a natural person who has created an account or uses the Services. Users under 14 must have parental consent (see Privacy Policy §8).

2.2. Account — your personal account in Fealthy.

2.3. Subscription — paid access to Fealthy features for a term, with auto-renewal unless canceled.

2.4. Subscription Tiers:

  • Free — basic features with limited AI and bank connection capabilities
  • Pro — enhanced features with increased AI and bank connection limits
  • Premium — full features with highest limits
  • Family — Premium features for up to 5 family members with shared budget capabilities

2.5. AI Features — automated analysis of your financial data using artificial intelligence for transaction categorization, spending insights, and predictions.

2.6. Voice Commands — speech-to-text functionality for creating records and controlling the application.

2.7. Bank Integration — read-only connection to your bank accounts via the Monobank API (additional Open Banking providers planned).

2.8. Shared Budget — a feature allowing multiple users to collaborate on budget management with configurable visibility settings.

2.9. User Content — data you upload or enter (e.g., notes, receipt images, documents).

2.10. Third-Party Services — services of banks, payment platforms (Apple, Google, Mono Pay), authentication, AI, speech-to-text, email, cloud, analytics, and communication providers, etc. The full list with data categories is set out in the Privacy Policy (§4).

3. License & Intellectual Property

3.1. We grant you a personal, revocable, non-exclusive, non-transferable license to use the Services in accordance with these Terms.

3.2. All rights in Fealthy’s trademarks, logos, source code, design, texts, AI models, and other content are owned by the Company or used under license.

3.3. You must not copy, modify, decompile, reverse engineer, distribute, or create derivative works of the Services unless permitted by law.

4. Account

4.1. You are responsible for the accuracy of information provided, the confidentiality of your password, and all actions in your Account.

4.2. We may suspend or close your Account for breaches of these Terms or law, or for security risks.

4.3. You may delete your Account at any time in settings. Consequences are described in Section 23.

5. Services Description

5.1. Fealthy is a personal finance management and analytics application that helps you:

  • Track income and expenses
  • Connect bank accounts for automatic transaction synchronization
  • Receive AI-powered spending insights and predictions
  • Categorize transactions automatically or manually
  • Use voice commands to create records
  • Collaborate on shared budgets with family and friends

5.2. We are NOT a bank and do not provide payment processing, investment, tax, or legal services or advice.

5.3. Bank integrations operate in read-only mode — we cannot execute payments, transfer funds, or modify your bank data.

5.4. All analytics, AI insights, and recommendations are informational only and do not constitute financial, investment, tax, or legal advice. You should consult qualified professionals for such advice.

6. Eligibility

6.1. Fealthy is intended for users aged 14 and older (under Ukrainian law). For EU users, national age thresholds apply (13–16 years depending on the member state). Users below the applicable threshold in their country of residence must have parental or guardian consent before using the Services. See the Privacy Policy (§8) for details, including how such consent is handled.

6.2. Your use must be lawful in your location. You confirm you are permitted to use the Services under your local laws.

7. Subscription Plans

7.1. Subscription Tiers:

7.2. Feature Limits: Each tier has specific limits on:

  • Number of AI-powered categorizations and insights per month
  • Number of bank accounts that can be connected
  • Access to premium features

7.3. Current tier limits and features are displayed in the app and may be updated from time to time.

8. Payments, Billing & Trials

8.1. Payment Methods:

  • App Store (Apple) — for iOS users
  • Google Play — for Android users
  • Mono Pay — direct payment option

8.2. Free Trial: New users may receive a 14-day free trial of paid features. Trial availability and terms are shown at signup.

8.3. Auto-Renewal: Subscriptions automatically renew at the end of each billing period until you cancel. For App Store and Google Play subscriptions, cancellation must be made at least 24 hours before the end of the current period — this is the respective platforms’ rule. For direct payments (Mono Pay), cancel before the end of the current period to avoid being charged for the next.

8.4. Price Changes: Prices, taxes, and currency are shown at purchase and may change. We will notify you of price changes as required by law or platform rules before they take effect.

8.5. Taxes: Applicable taxes and fees (e.g., VAT) may be added to the price as required by law.

9. Refunds & Cancellation

9.1. App Store / Google Play Purchases:

  • Refunds are handled according to the respective platform’s policies
  • Contact Apple or Google directly for refund requests
  • We do not control and cannot process refunds for platform purchases

9.2. Direct Payments (Mono Pay):

  • You may cancel your subscription at any time
  • Upon cancellation, you retain access to paid features until the end of the current billing period
  • No prorated refunds are provided for partial periods
  • For exceptional circumstances, contact us at hello@fealthy.com.ua

9.3. How to Cancel:

  • App Store: Settings > Apple ID > Subscriptions
  • Google Play: Play Store > Subscriptions
  • Mono Pay: In-app Settings > Subscription > Cancel

9.4. EU Consumer Right of Withdrawal: If you are a consumer in the European Union, you have the right to withdraw from the contract within 14 days of purchase without giving reasons. However, if you have expressly consented to the immediate provision of the digital service and acknowledged that you lose the right of withdrawal once provision begins, the right of withdrawal no longer applies. To exercise this right, contact hello@fealthy.com.ua.

10. Downgrade Policy

10.1. If you downgrade from a paid tier to Free (or a lower paid tier):

  • Your data is preserved — we do not delete your historical data
  • Premium features become locked — you lose access to features not included in your new tier
  • Limits apply immediately — new tier limits apply to AI features and bank connections

10.2. To restore access to premium features, you may upgrade again at any time.

11. User Content & Permissions

11.1. You retain rights to your User Content and grant the Company a limited license to store, process, and display it solely to provide the Services.

11.2. You warrant you have all rights to the Content you upload and that it does not violate law or third-party rights.

11.3. We may remove or block Content if we reasonably believe it violates these Terms or law.

11.4. Feedback and Suggestions: Any feedback or suggestions you provide may be used by us without compensation under a non-exclusive, perpetual, royalty-free license.

12. AI Features

12.1. What AI Does:

  • Automatically categorizes transactions (e.g., groceries, transport, entertainment)
  • Provides spending insights and pattern analysis
  • Generates predictions for future expenses and savings opportunities

12.2. AI Limitations:

  • AI analysis is based on transaction data and may not always be accurate
  • AI suggestions are informational only and not financial advice
  • AI performance may vary based on data quality and availability

12.3. AI Opt-Out: You may disable AI features at any time in your account settings. Opting out does not affect other Services.

12.4. Usage Limits: All subscription tiers have limits on AI feature usage. Limits reset monthly and are displayed in your account.

13. Voice Commands

13.1. Fealthy supports voice commands for creating records and controlling the application.

13.2. Voice Processing:

  • Audio is transmitted to third-party speech-to-text providers — AssemblyAI (primary, US) and OpenAI Whisper (fallback, US)
  • Fealthy does not store voice recordings on its own infrastructure; providers may briefly retain audio under their own privacy policies
  • Only the resulting text commands are saved
  • See the Privacy Policy (§4.7, §11) for details

13.3. Microphone Permission: Voice features require microphone access. You control this permission in your device settings. Voice features will not work without this permission.

13.4. Voice commands are an optional feature — all functionality is available without using voice.

14. Bank Integration

14.1. Read-Only Access: When you connect a bank account, Fealthy receives read-only access to:

  • Account balance
  • Transaction history
  • Income and expense data

14.2. We Cannot:

  • Initiate transfers or payments
  • Modify any bank data
  • Obtain your bank login or password — connection is established via scoped API tokens issued by the bank itself

14.3. Currently Supported: Monobank (via official API)

14.4. Future Support: We plan to add more banks through Open Banking APIs as they become available in Ukraine.

14.5. Connection Limits: The number of bank accounts you can connect depends on your subscription tier.

14.6. Disconnecting: You can disconnect any bank account at any time in Settings > Connected Accounts. Upon disconnection:

  • We immediately stop receiving new data from that bank
  • Previously synced data remains in your account (you can delete it separately)

15. Shared Budgets & Family Plan

15.1. Shared Budgets:

  • Create budgets shared with family members or friends
  • Each participant controls the visibility of their own data
  • Custom visibility settings available per item

15.2. Family Plan:

  • Includes up to 5 family members
  • Each member gets their own account with Premium features
  • Family members can participate in shared budgets
  • The plan owner manages family membership

15.3. Privacy in Shared Budgets:

  • Other members can only see data you explicitly share
  • Your personal transactions outside shared budgets remain private
  • You control what is visible to other group members

15.4. Leaving Groups: You can leave any shared budget at any time. Your future data will no longer be visible to group members.

16. Conduct & Prohibited Uses

16.1. You must not:

  • (a) Violate any law or third-party intellectual property rights
  • (b) Attempt unauthorized access or circumvent security measures
  • (c) Harvest or scrape other users’ data
  • (d) Distribute malware, spam, or malicious content
  • (e) Use the Services for fraud, money laundering, or other illegal activity
  • (f) Interfere with or disrupt the Services
  • (g) Create multiple accounts to circumvent limits or restrictions
  • (h) Resell or commercially exploit the Services without authorization

17. Data & Privacy

17.1. Processing of personal data is governed by Fealthy’s Privacy Policy (latest version available in the app and at our website).

17.2. Bank and aggregator connections occur via Third-Party Services under their policies. We share the minimum necessary data for integrations to function.

18. Data Accuracy & Disclaimers

18.1. We aim to display and aggregate your financial data correctly, but we do not guarantee the absence of errors, including delays or failures of Third-Party Services (banks, payment platforms).

18.2. The Services are provided “AS IS” and “AS AVAILABLE”, without warranties of fitness, error-free operation, uninterrupted availability, or fitness for a particular purpose.

18.3. Uptime: We aim to maintain high availability but do not guarantee any specific uptime percentage. We are not liable for service interruptions due to maintenance, updates, or circumstances beyond our control.

18.4. Fealthy does not provide financial, investment, tax, or legal advice. All analytics and recommendations are for informational purposes only.

19. Limitation of Liability

19.1. To the fullest extent permitted by law, the Company, its directors, employees, and partners are not liable for:

  • Indirect, incidental, special, punitive, or consequential damages
  • Loss of profits, data, or goodwill
  • Outages or inability to access the Services
  • Actions of Third-Party Services
  • Inaccuracies in financial data or AI analysis

19.2. Our total aggregate liability for any claims shall not exceed the amount you actually paid for the Subscription in the last 3 months, unless mandatory law requires otherwise.

20. Indemnification

20.1. You agree to indemnify and hold the Company harmless from losses, costs, and third-party claims arising from:

  • Your breach of these Terms or law
  • Your prohibited use of the Services
  • Your infringement of third-party rights
  • Content you upload or share

21. Beta Features

21.1. We may offer beta or experimental features that are:

  • Provided “as is” without warranties
  • Subject to change or discontinuation at any time
  • Not covered by any service level commitments

21.2. Beta features are clearly labeled in the app. Your use of beta features is at your own risk.

22. Updates & Changes

22.1. We may modify these Terms, features, or availability of the Services. Material changes (those affecting your rights, the price, or the scope of the Services) take effect 30 days after notice via the channels in §22.2. Non-material changes (clarifications, typo fixes, formatting) take effect upon publication.

22.2. For material changes, we will notify you through the channels below, in order of reliability: a prominent notice on the website and in the app (primary channel); email and push notification (secondary, best-effort channels).

22.3. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms. If you do not agree to a material change, you may reject it by ceasing to use the Services and/or deleting your Account before the change takes effect.

23. Termination & Aftermath

23.1. Your Right to Terminate: You may stop using the Services at any time by deleting your Account or canceling your Subscription.

23.2. Our Right to Terminate: We may suspend or terminate your access if you breach these Terms, violate law, or create security risks.

23.3. Effects of Termination:

  • Your access to paid features ends at the close of the paid period
  • Data processing and deletion follow the Privacy Policy (§5.2: the account is flagged for deletion within 1 hour and deactivated; backups, logs, and files roll off within 30 days; active-database records are erased per §5.2.3)
  • Bank connections are immediately severed
  • Shared budget memberships are terminated

23.4. Surviving Provisions: Sections on intellectual property, limitation of liability, indemnification, governing law, and dispute resolution survive termination.

24. Third-Party Services

24.1. Your use of Third-Party Services (Apple, Google, Monobank, Mono Pay, etc.) is governed by their respective terms and policies. We do not control and are not responsible for their operation or content.

24.2. In billing or refund conflicts involving app stores, the platform’s (Apple/Google) rules prevail.

25. Governing Law & Dispute Resolution

25.1. Unless mandatory rules dictate otherwise, these Terms are governed by the laws of Ukraine.

25.2. Disputes are subject to prior informal resolution (letter or email). If unresolved within 30 days, the dispute shall be submitted to the competent courts of Ukraine at the Company’s registered address (Ternopil).

25.3. Nothing in these Terms limits any rights you may have under applicable consumer protection laws.

26. Electronic Communications

26.1. You consent to receive electronic communications from us (email, push notifications) related to:

  • The Services and your account
  • Security alerts and important updates
  • Changes to Terms or policies
  • Marketing — only with your separate consent given at sign-up or in account settings. You may withdraw consent at any time via settings or the “Unsubscribe” link in any email (see Privacy Policy §3.4)

27. Technical Requirements

27.1. A compatible device, operating system, and internet connection are required to use the Services. Specific requirements are listed in the app stores.

27.2. Network charges may apply according to your provider’s tariffs. You are responsible for any data charges.

27.3. We implement appropriate organizational and technical security measures; however, no system is 100% secure.

28. Miscellaneous

28.1. Severability: If any provision is invalid or unenforceable, the remainder remains effective. The invalid provision shall be replaced by one that best reflects the parties’ intent.

28.2. No Waiver: A delay or failure to exercise a right is not a waiver of that right.

28.3. Assignment: You may not assign your rights or obligations without our written consent. We may assign ours in connection with reorganization or business transfer.

28.4. Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the Services.

28.5. Language: These Terms are prepared in Ukrainian and English. In case of discrepancies, the Ukrainian version prevails.
